(hereinafter referred to as "Tommi Technology") hereby reminds you (the user) to carefully read this User Agreement (hereinafter referred to as "the Agreement") before registering as a user to ensure that you fully understand the terms of this Agreement. Please read carefully and choose to accept or not accept this agreement. Unless you accept all the terms of this agreement, you have no right to register, log in or use the services under this agreement. Your registration, login, use and other behaviors will be deemed as acceptance of this agreement, and you agree to be bound by the terms of this agreement.
This agreement stipulates the rights and obligations between Tommi Technology and the user with respect to the software services (hereinafter referred to as "services") of "PickFun". "Users" refer to individuals who register, log in and use the Service. This agreement can be updated by Tommi Technology at any time. Once the updated agreement terms are published, they will replace the original agreement terms without further notice. Users can consult the latest version of the agreement terms on this website. After Tommi Technology modifies the terms of the agreement, if the user does not accept the modified terms, please immediately stop using the services provided by Tommi Technology. If the user continues to use the services provided by Tommi Technology, it will be deemed to accept the modified agreement.
1)Before using this service, users need to register a "PickFun" account. The "PickFun" account shall be registered using an email address. The user shall register the "PickFun" account using an email address that has not been registered before and has not been banned by Tommi Technology according to this agreement. Tommi Technology may change the way of account registration according to user needs or product requirements without prior notice to the user.
2)When users register and use this service, Tommi Technology needs to collect personal information that can identify users so that Tommi Technology can contact users when necessary, or provide users with a better use experience. The information collected by Tommi Technology includes but is not limited to the user's name, gender, age, date of birth, personal description; Tommi Technology agrees that the use of such information will be subject to Article 3: User personal information protection.
The specific content of this service is provided by Tommi Technology according to the actual situation, including but not limited to authorized users' instant messaging, adding friends, joining groups, following others, and posting messages through their accounts. Tommi Technology can change its services, and the service content provided by Tommi Technology may change at any time; Users will receive the notice of service change from Tommi Technology.
1. In the process of registering an account or using this service, users may need to fill in or submit some necessary personal information, such as the identity information required to be filled in by laws and regulations, regulatory documents (hereinafter referred to as "laws and regulations"). If the information submitted by the user is incomplete or does not conform to the provisions of laws and regulations, the user may not be able to use the service or be restricted in the process of using the service.
2. User personal information includes:
a.Personal information provided by users themselves (such as email and other personal information filled in during registration, and shared information provided when using the service);
b.User personal information shared by other parties;
c.Tommi Technology legally collects necessary personal information of users for providing services (such as equipment or software information automatically collected by the system when using the service, browsing historical information, communication time information and other technical information, and geographic location information when users open the positioning function and use the service).
Personal privacy information refers to the information related to the user's personal identity or personal privacy, such as the user's real name, mobile device ID, IP address, and user chat record. Non personal private information refers to the basic recorded information, other general information beyond the scope of personal privacy information, and the above private information that users have agreed to disclose, such as the user's operation status and usage habits of the service, which are clearly and objectively reflected in the Tommi Technology server. Tommi Technology guarantees to collect, use or disclose the user's personal privacy information with the user's written consent. The user agrees that Tommi Technology can collect, use or disclose the user's non personal privacy information without obtaining the user's additional confirmation and authorization.
3.It is a consistent system of Tommi Technology to respect the privacy of users' personal information. Tommi Technology will take technical measures and other necessary measures to ensure the security of users' personal information and prevent the leakage, damage or loss of users' personal information collected in this service. In case of the above situations or when Tommi Technology finds that the above situations may occur, Tommi Technology will take remedial measures in a timely manner and inform the user. If the user finds that the above situations exist, he/she should also contact Tommi Technology immediately.
4. Tommi Technology will not disclose the user's personal privacy information to any third party without the user's consent. Except for the following specific circumstances:
(1) Tommi Technology provides users' personal privacy information according to laws and regulations or the instructions of competent authorities;
(2) Any disclosure of personal information caused by users' informing others of their user passwords or sharing their registered accounts and passwords with others, or other disclosure of personal privacy information not caused by Tommi Technology;
(3) Users disclose their personal privacy information to a third party by themselves;
(4) The user has reached an agreement with Tommi Technology and its partners on the use and disclosure of the user's personal privacy information. Therefore, Tommi Technology will disclose the user's personal privacy information to the partners;
(5) Any disclosure of users' personal privacy information due to hacker attacks, computer virus intrusion and other force majeure events;
(6) The user's personal information has been processed and cannot be identified and restored.
5. The user agrees that Tommi Technology can use the user's personal privacy information in the following matters:
(1) Tommi Technology timely sends important notices to users, such as software updates and changes to the terms of this agreement;
(2) Tommi Technology conducts internal audit, data analysis and research to improve its products, services and communication with users;
(3) According to the agreement, Tommi Technology manages, reviews user information and takes handling measures;
(4) Other matters stipulated by applicable laws and regulations.
In addition to the above, without the user's prior consent, Tommi Technology will not use the user's personal privacy information for any other purpose.
6. Tommi Technology attaches great importance to the protection of minors' personal information. Tommi Technology will rely on the personal information provided by users to determine whether users are minors. Any minor under the age of 18 should obtain the written consent of the parent or its legal guardian (hereinafter referred to as "guardian") in advance to register an account or use this service. Tang Mi Technology will not use or disclose the chat records and other personal information of minors to any third party except according to the provisions of laws and regulations and the instructions of competent authorities. Except for the exceptions agreed in this agreement, Tommi Technology will not use or disclose the personal information of minors to any third party without the prior consent of the guardian.
7. In order to improve the technology and services of Tommi Technology and provide better service experience to users, Tommi Technology may collect and use the user's non personal private information by itself or provide it to a third party.
8. Tommi Technology guarantees to collect, use or disclose the user's personal information under the principles of legality, legitimacy and necessity and will not collect the user's personal information irrelevant to the services provided.
9. Tommi Technology attaches great importance to the protection of users' personal privacy, and has formulated the Tommi Technology Privacy Policy. Users can also check the "Help" on the "Settings" page. Users who confirm and agree to use the services provided by Tommi Technology will be deemed to accept the Tommi Technology Privacy Policy.
1. The content mentioned in this article refers to any content created, uploaded, copied, published and disseminated by the user in the process of using this service, including but not limited to the registration information and authentication materials such as account avatar, name, user description, or text, voice, picture, video, image and text sending, replying or automatic replying messages and related link pages, as well as other content generated by using the account or this service.
2. Users shall not make, upload, copy, publish or disseminate the content prohibited by the following laws, regulations and policies by using the "PickFun" account or this service:
(1) Opposing the basic principles set forth in the Constitution;
(2) Endangering national security, divulging state secrets, subverting state power and undermining national unity;
(3) Harming the honor and interests of the state;
(4) Inciting national hatred and discrimination and undermining national unity;
(5) Those who undermine the state's religious policy and promote heresy and feudal superstition;
(6) Spreading rumors, disturbing social order and undermining social stability;
(7) Spreading obscenity, pornography, gambling, violence, murder, terror or abetting crime;
(8) Insult or slander others and infringe upon their legitimate rights and interests;
(9) Failing to comply with the "seven bottom lines" requirements of the bottom line of laws and regulations, the bottom line of the socialist system, the bottom line of national interests, the bottom line of citizens' legitimate rights and interests, the bottom line of social and public order, the bottom line of morality and fashion, and the bottom line of information authenticity;
(10) Information containing other contents prohibited by laws and administrative regulations.
3. Users shall not use the "PickFun" account or this service to create, upload, copy, publish or disseminate the following content that interferes with the normal operation of "PickFun" and infringes the legitimate rights and interests of other users or third parties:
(1) Containing any sex or sexual implication;
(2) Those with abusive, threatening or threatening contents;
(3) Contain harassment, rubbish advertisement, malicious information and deception information;
(4) Involving other people's privacy, personal information or data;
(5) Infringing upon the right of reputation, portrait, intellectual property, trade secret and other legal rights of others;
(6) It contains other information that interferes with the normal operation of the service and infringes the legitimate rights and interests of other users or third parties.
1. Any content transmitted or published by users in or through this service does not reflect or represent, nor should it be deemed to reflect or represent the views, positions or policies of Tommi Technology, and Tommi Technology does not assume any responsibility for this.
2. Users shall not use the "PickFun" account or this service to conduct the following acts:
(1) Submitting or publishing false information, or misappropriating others' avatars or materials, or posing as or using others' names;
(2) Forcing or inducing other users to follow, click on the link page or share information;
(3) Fabricating facts or concealing the truth to mislead or deceive others;
(4) Abusing account registration by technical means;
(5) Engaging in any illegal and criminal activities by using the "Tommi Technology" account or this service;
(6) Making and publishing methods and tools related to the above behaviors, or operating or disseminating such methods and tools, regardless of whether these behaviors are for commercial purposes;
(7) Other acts that violate laws and regulations, infringe the legitimate rights and interests of other users, interfere with the normal operation of "Tommi Technology" or Tommi Technology does not expressly authorize.
3. The user must be fully responsible for the authenticity, legality, harmlessness, accuracy, validity, etc. of the information transmitted by using the "PickFun" account or this service. Any legal liability related to the information transmitted by the user shall be borne by the user, and has nothing to do with Tommi Technology. If damage is caused to Tommi Technology or a third party, the user shall compensate according to law.
4. The services provided by Tommi Technology may include advertisements, and users agree to display advertisements provided by Tommi Technology and third-party suppliers and partners during use. Except as expressly provided by laws and regulations, users shall be responsible for the transactions conducted according to the advertising information, and Tang Mi Technology shall not be responsible for the losses or damages suffered by users due to the transactions conducted according to the advertising information or the content provided by the aforementioned advertisers.
5. The user shall not engage in any of the following activities except with the written permission of Tommi Technology:
(1) Delete the copyright information on the software and its copies;
(2) Reverse engineer, reverse assemble, reverse compile the software, or try to discover the source code of the software in other ways;
(3) Use, rent, lend, copy, modify, link, reprint, compile, publish, publish, set up mirror sites, etc. of the intellectual property content owned by Tommi Technology;
(4) Copy, modify, add, delete, attach or create any derivative works of the software or data released to any terminal memory during the software operation process, interactive data between the client and server during the software operation process, and system data necessary for the software operation, including but not limited to the use of plug-ins Plug in or third-party tools/service access software and related systems not authorized by Tommi Technology;
(5) By modifying or forging the instructions and data in the software operation, add, delete, change the function or operation effect of the software, or operate or disseminate the software and methods used for the above purposes to the public, regardless of whether these acts are for commercial purposes;
(6) Log in to or use Tommi Technology software and services through third-party software, plug-ins, plug-ins, and systems not developed or authorized by Tommi Technology, or make, publish, and disseminate third-party software, plug-ins, plug-ins, and systems not developed or authorized by Tommi Technology.
1. The ownership of the "PickFun" account belongs to Tommi Technology. After the user completes the application for registration, he/she will obtain the right to use the "PickFun" account. The right to use the account belongs only to the initial applicant, and it is prohibited to give, borrow, rent, transfer or sell it. Due to business needs, Tommi Technology has the right to recover the user's "PickFunform" account.

2) The "Account and Security" page in the "Settings" page is used to query, change, delete and cancel the personal data, registration information and transmission content on the "PickFun" account. However, it should be noted that the deletion of relevant information will also delete the text and pictures saved in the system. Users need to bear this risk.
3. The user is responsible for keeping the security of the registered account information and the account password properly. If the user does not keep the account properly, it may lead to the theft of the account or password, and the responsibility shall be borne by the user. The user needs to bear legal responsibility for the behavior under the registered account and password. The user agrees not to use the account or password of other users under any circumstances. When the user suspects that others use their account or password, the user agrees to notify Tommi Technology immediately.
4. The user shall abide by the terms of this agreement and use the service correctly and appropriately. If the user violates any of the terms of this agreement, Tommi Technology has the right to suspend or terminate the provision of services to the defaulting user's "PickFun" account according to the agreement after notifying the user. At the same time, Tommi Technology reserves the right to withdraw the account and user name of "Pike Party" at any time.
5. If the user does not log in one year after registering the "PickFun" account, after notifying the user, Tommi Technology can withdraw the account to avoid waste of resources, and the adverse consequences arising therefrom shall be borne by the user.
6. The user can cancel the account through the "Account and Security" page in the "Settings" page. The user confirms that the account cancellation is an irreversible operation. The user should back up the information and data related to the Tommi Technology account. All services related to the Tommi Technology account have been properly handled before the user confirms the operation. After the user confirms and agrees to cancel the account, it does not mean that the account behavior and related responsibilities before the cancellation of the account of Tommi Technology are exempted or mitigated. If during the cancellation period, the user's account is complained by others, investigated by national authorities, or is in litigation or arbitration proceedings, Tommi Technology Co., Ltd. will terminate the user's account cancellation without the user's consent.
1. Tommi Technology is not responsible for the user's failure to delete or store relevant data in the service.
2. Tommi Technology can determine the maximum storage period of the user's data in the service according to the actual situation, and allocate the maximum data storage space on the server. Users can back up relevant data in the service according to their own needs.
3. If the user stops using the service or the service terminates, Tommi Technology can permanently delete the user's data from the server. After the service is stopped or terminated, Tommi Technology has no obligation to return any data to the user.

The user understands and agrees that "PickFun" only provides the user with a platform for information sharing, transmission and acquisition, and the user must be responsible for all acts under his/her registered account, including any content transmitted by the user and any consequences arising therefrom. Users shall make their own judgments on "Tommi Technology" and the content in this service, and bear all risks arising from the use of the content, including risks arising from reliance on the correctness, integrity or practicality of the content. Tommi Technology cannot and will not be liable for any loss or damage caused by the user's behavior.
2. Users understand and agree that Tommi Technology reserves the right to unilaterally change, suspend, terminate or revoke all or part of the service content due to business development needs, and users need to bear this risk.
1. Except that the intellectual property rights related to advertising in this service are owned by the corresponding advertisers, the intellectual property rights of the content provided by Tommi Technology in this service (including but not limited to web pages, text, pictures, audio, video, charts, etc.) belong to Tommi Technology, except that users have legally obtained the intellectual property rights of their published content before using this service.
2. Unless otherwise specified, the copyright, patent right and other intellectual property rights of the software on which Tommi Technology provides this service belong to Tommi Technology.
3. Tommi Technology owns the copyright or trademark of the graphics, words or their components involved in this service, as well as other PickFun logos and product and service names (hereinafter collectively referred to as "PickFun logos"). Without the prior written consent of Tommi Technology, the user shall not display, use or otherwise dispose of the PickFun logo in any way, nor indicate to others that the user has the right to display, use or otherwise dispose of Tommi Technology logo.
4. The above and any other intellectual property rights legally owned by Tommi Technology or relevant advertisers are protected by law. Without the written permission of Tommi Technology or relevant advertisers, users are not allowed to use or create relevant derivative works in any form.

If Tommi Technology finds or receives reports or complaints from others that the user violates the agreement, Tommi Technology has the right to review and delete the relevant content, including but not limited to user data and chat records, and impose penalties on the violating account, including but not limited to warnings, account bans, equipment bans and function bans, depending on the seriousness of the case, and notify the user of the handling results.
2. The user understands and agrees that Tommi Technology has the right to punish any user who violates relevant laws and regulations or this Agreement according to reasonable judgment, take appropriate legal actions against any user who violates laws and regulations, and save relevant information to report to relevant departments according to laws and regulations, and the user shall bear all legal liabilities arising therefrom.
3. The user understands and agrees that, for any claim, demand or loss claimed by any third party, including reasonable attorney's fees, due to the user's violation of this agreement, the user shall compensate Tommi Technology and its cooperative companies and affiliated companies, and keep them free from damage.
1. The user understands and confirms that the service may be interrupted due to force majeure and other risk factors in the process of using the service. Force majeure refers to unforeseeable, insurmountable and unavoidable objective events that have a significant impact on one or both parties, including but not limited to natural disasters such as floods, earthquakes, epidemics and storms, as well as social events such as wars, riots, government actions, etc. In case of the above situations, Tommi Technology will try to cooperate with relevant units at the first time to repair in a timely manner. However, Tommi Technology and its partners will be exempted from liability for the losses caused to users or third parties within the scope permitted by law.
2. Like most Internet services, this service is affected by differences in factors including but not limited to user reasons, network service quality, social environment, etc., and may be harassed by various security issues, such as harassment in real life caused by others using user information; Other software downloaded and installed by the user or other websites visited by the user contain viruses such as "Trojan Horse", which threaten the security of the user's computer information and data, and then affect the normal use of the service. Users should strengthen the awareness of information security and user data protection, and pay attention to strengthening password protection to avoid loss and harassment.
3. The user understands and confirms that there is a risk of service interruption or failure to meet the user's requirements due to force majeure, computer virus or hacker attacks, system instability, user location, user shutdown, and any other technology, internet, communication lines, etc., and Tang Mi Technology will not bear any responsibility for any loss caused to users or third parties.
4. The user understands and confirms that there is misleading, deceptive, threatening, defamatory, objectionable or illegal information from any other person, or anonymous or pseudonymous information that infringes the rights of others, as well as the behavior accompanying such information, and Tang Mi Technology will not bear any responsibility for any loss caused to the user or the third party.
5. The user understands and confirms that Tommi Technology needs to regularly or irregularly overhaul or maintain the "PickFun" platform or related equipment. If the service is interrupted within a reasonable time due to such circumstances, Tommi Technology does not have to bear any responsibility for this, but Tommi Technology should make a notice in advance.
6. In accordance with laws and regulations and this agreement, Tommi Technology has the right to deal with violations or breaches of laws and regulations. This right does not constitute Tommi Technology's obligations or commitments. Tommi Technology cannot guarantee that it will find violations or breaches of laws and regulations in a timely manner or deal with them accordingly.
7. The user understands and confirms that Tommi Technology is not responsible for the quality defects of the following products or services provided to the user and any losses caused by them:
(1) Tommi Technology provides users with free services;
(2) Any products or services provided by Tommi Technology to users.
8. In no case will Tommi Technology be liable for any indirect, consequential, punitive, accidental, special or penal damages, including the loss of profits suffered by users using "PickFun" or the Service (even if Tommi Technology has been informed of the possibility of such losses). Although this agreement may contain contrary provisions, Tommi Technology's full responsibility to the user, regardless of the reason or behavior, will never exceed the cost (if any) paid by the user to Tommi Technology for using the services provided by Tommi Technology.
1. In view of the particularity of the network service, the user agrees that Tommi Technology has the right to change, interrupt or terminate part or all of the service (including the charging service) at any time. For services changed, interrupted or terminated by Tommi Technology, Tommi Technology shall notify users before the change, interruption or termination, and shall provide equivalent alternative services to the affected users; If the user is unwilling to accept the alternative service, if the user has already paid the service fee to Tommi Technology, Tommi Technology shall return the remaining amount to the user's payment account after deducting the corresponding service fee according to the actual use of the service by the user.
2. In case of any of the following circumstances, Tommi Technology has the right to change, interrupt or terminate the free services or charging services provided to users without any liability to users or any third party:
(1) The user shall submit true information according to the law, but the personal data provided by the user is untrue or inconsistent with the information at the time of registration and fails to provide reasonable proof;
(2) The user violates relevant laws and regulations or this agreement;
(3) According to the law or the requirements of the competent authority;
(4) For safety reasons or other necessary circumstances.
1. Tommi Technology solemnly reminds users to pay attention to the clauses in this agreement that exempt Tommi Technology from liability and restrict users' rights. Users are requested to read carefully and consider risks independently. The minor shall read this agreement with the legal guardian.
2. The validity, interpretation and dispute resolution of this agreement are applicable to the laws of the People's Republic of China. In case of any dispute or controversy between the user and Tommi Technology, it shall be settled through friendly negotiation. If the negotiation fails, the user agrees to submit the dispute or controversy to the people's court with jurisdiction in the place where Tommi Technology is located.
3. Any provision of this agreement is invalid or unenforceable for whatever reason, the remaining provisions are still valid and binding on both parties.
4. Due to the rapid development of the Internet, the terms and conditions listed in this agreement signed between you and Tommi Technology may not fully list and cover all the rights and obligations of you and Tommi Technology, and the existing agreements cannot guarantee that they will fully meet the needs of future development. Therefore, Tommi Technology's privacy policy and Tommi Technology's platform code of conduct are supplementary agreements to this agreement, which are inseparable from this agreement and have the same legal effect. If you use Tommi technology platform services, you are deemed to agree to the above supplementary agreement.
